Terms and Conditions of the “Welcome Promotion”

(hereinafter referred to as the “ Terms and Conditions”) 

§ 1. Organizer 

The Organizer of the “Welcome Promotion” (hereinafter referred to as the “Promotion”) is WebWave sp. z o.o., with its registered office in Warsaw (02-676) at Postępu 14, entered into the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000851194, NIP: 5272931749, REGON: 386580113, with a share capital of PLN 5,000 (hereinafterreferred to as the “Organizer”). 

§ 2. Duration of the Promotion 

The Promotion is valid from May 6, 2026, to September 30, 2026 (hereinafter referred to as the “Promotion Period”).  

The Organizer reserves the right to extend the Promotion Period or introduce subsequent editions of the Promotion. Information about such changes  will be published on the Organizer's website. 

§ 3. Participants 

The Promotion is open to consumers (within the meaning of  Art. 22¹ of the Polish Civil Code) as well as business entities, including natural persons with full legal capacity, legal persons, foundations, and associations with their registered office and tax residency in Poland (hereinafter referred to as the “Participant”), who meet the conditions specified in these Terms and Conditions during the Promotion Period. 

Participation in the Promotion is voluntary and requires the Participant’s consent to receive commercial information from the Organizer and Wenet Group companies (Wenet Group S.A., Wenet sp. z o.o., Firmao Polska sp. z o.o.) via  electronic communication channels (e-mail, SMS, and telephone), along with related consent to the processing of  personal data for marketing purposes. 

Each Participant may use the Promotion only once. The discount applies to the first subscription period and must be used within 7 days of registering an account in the WebWave website builder. After the initial subscription period, the service will renew at the Organizer’s standard rates applicable on the renewal date. One e-mail address entitles the Participant to one discount. 

The Participant declares they are not a current customer of the Organizer, do not have an active agreement with the Organizer, and have not previously used the Organizer's services under a valid agreement or other legal basis. 

By participating  in the Promotion, the Participant confirms that they are authorized to act on behalf of the entity whose details are provided during  registration (e.g., as a legal representative or authorized proxy). 

The Organizer reserves the right to request additional documents confirming such authorization. Failure to provide such documents may result in exclusion from the Promotion. 

§ 4. Subject and Conditions of Participation 

The Organizer, called WebWave (hereinafter referred to as “WebWave”), owns and operates the WebWave website builder, available at https://webwave.me, which enables users to create websites and online stores. WebWave offers various paid subscription plans: One Pager, Pro, and Business (hereinafter referred to as “Plan”), which differ in technical features and duration. 

The Promotion consists of a 30% (thirty percent) discount (hereinafter referred to as the “Discount”) on a selected annual Plan, subject to these Terms and Conditions. 

The Discount applies exclusively to the Plan fee and does not cover additional services such as domain registration or other paid add-ons. 

To participate, the Participant must read and accept these Terms and Conditions. 

To receive the Discount, the Participant must: 

• Create an account at https://webwave.me/sign-up by providing an e-mail address and password, and a phone number is optional) 

• Grant the marketing consents referred to in §3 sec. 2. These consents may be withdrawn at any time; however, withdraw will result in the loss of  the Promotion benefits, and continuation of services at standard rates. 

• Purchase and pay in advance for an annual Plan  within 7 days of creating the account. 

The Discount is granted only if the Plan is purchased within  the Promotion Period and within the 7-day period reffered above. After this period, the right to the Discount expires. 

7. This Promotion cannot be combined with any other zctive promotions or discounts, unless explicitly stated otherwise.  

The Discount is non-transferable and cannot be exchanged for cash.

§ 5. Personal Data and Privacy 

The provisions of this section apply exclusively to Participants who are natural persons. 

The personal data of a Participant who is a natural person or a natural person conducting business activity (“Participant Data”) includes all information provided to the Organizer by the Participant in connection with participation in the Promotion, in particular identification and contact details, information regarding the business activity conducted, billing data, the content of correspondence and recorded telephone conversations, with the exception of data entrusted to the Organizer by the Participant. 

The controller of Participant Data is WebWave sp. z o.o., with its registered office in Warsaw (02-676) at ul. Postępu 14, entered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000851194, with Tax ID (NIP) 5272931749 and Statistical ID (REGON) 386580113.  

The Organizer processes the Participant’s Data:  

for the purpose of conducting the Promotion and providing services to the Participant - in accordance with Article 6(1)(b)  GDPR;  

for compliance with legal obligations, including tax obligations related to the Participant’s participation in the Promotion - in accordance with Article 6(1)(c) of the GDPR;  

for marketing purpose of conducting marketing activities by the Organizer within the scope of the controller’s legitimate interest - in accordance with Article 6(1)(f) GDPR, considering the Participant’s consents arising from the GDPR, the Act on the Provision of Electronic Services, and the Electronic Communications Law. These consents may be withdrawn at any time without affecting the lawfulness of the processing carried out prior to their withdrawal;  

for the purpose of fulfilling the Organizer’s legal obligations toward the Participant - in accordance with Article 6(1)(c) of the GDPR.  

The Participant’s personal data will be retained:  

for the duration of participation in the Promotion and service provision; 

for the period required by applicable tax and accounting laws,  

in the case of data processed on the basis of consent - until such consent is withdrawn,  

to the extent necessary to assert or defend claims - until the expiration of the statute of limitations for claims.  

The Participant has the right to access, rectify, erase, restrict processing, transfer data, and object to processing.

The Participant has the right to lodge a complaint with the President of the Personal Data Protection Office.

§ 6. Complaints 

Complaints regarding the Promotion may be submitted during the Promotion Period or within 30 days from the date of account creation. 

Complaints should be submitted to: contact@webwave.me 

A complaint should include: the Participant’s first name, last name, and email address used for registration the account in the WebWave creator, the reason for the complaint, a description of the issue, and the justification for the complaint and the requested resolution. 

The complaint will be reviewed within 14 days of its proper submission to the Organizer. 

A response to the complaint will be sent to the Participant via email to the address from which the complaint was submitted .  

Complaints submitted to an incorrect email address, submitted after the deadline specified in point 1 above, or lacking  required information referred to in point 3 above may not be considered. 

§ 7. Final Provisions 

These Terms and Conditions enter into force upon the announcement of the Promotion. The Organizer reserves the right to amend the Terms and Conditions for valid reasons, including:  

changes in legal regulations governing the rules of distance selling;  

organizational reasons affecting changes regarding: the Organizer’s address, name, or legal form;  

technical or technological changes affecting the functionality of the WebWave creator, provided that such changes, with respect to a distance contract concluded by a consumer or an entity with consumer rights, must not prove less favorable than the terms in effect at the time of participating in the Promotion, 

actions benefiting Participants, e.g., by extending the duration of the Promotion. 

Participants will be notified of any changes to these Terms and Conditions via the Organizer's website. 

Any changes to the Terms and Conditions will take effect on the date set by the Organizer, but no earlier than 7 days afterpublication. 

This Promotion constitutes a temporary marketing campaign and does not constitute a public promise within the meaning of applicable law. 

The Organizer is not responsible if a Participant cannot use the Promotion due to their own technical issues, such as problems with their device or internet connection. 

In matters not covered by these Terms and Conditions, the provisions of the WebWave Terms and Conditions available at: https://webwave.me/terms-of-use shall apply (including those regarding the consumer's right to withdraw from a distance contract), as well as the provisions of Polish law, in particular the Act of 23 April 1964 – Civil Code and the Act of 30 May 2014 on Consumer Rights.
