Regulations of the “Black Month 2025” promotion for customers whose Premium Plan has expired
I. INTRODUCTORY INFORMATION
These terms and conditions (hereinafter the “Regulations”) set out the rules for using the “Black Month 2025” promotion, organized by WebWave sp. z o.o., with its registered office in Warsaw (02-676), ul. Postępu 14, KRS: 0000851194, NIP: 527-293-17-49, REGON: 386580113 (hereinafter the “Organizer”).
The Organizer is the owner of a website builder enabling users to create websites, including online stores, under the name WebWave (hereinafter “WebWave”). WebWave is available at webwave.me. Use of WebWave takes place via the user panel (the “Webmaster Panel”) and is available free of charge or for a fee after selecting the appropriate payment plan (a “Premium Plan”, with each Premium Plan hereinafter referred to individually as a “Plan”), with Premium Plans differing in the technical conditions offered. The Promotion covers the use of the One Pager Plan, Pro Plan, and Business Plan for 12 months.
1. Price for One Pager Plan - $84 annually/ $7 per month,
2. Price for Pro Plan - $120 annually/ $10 per month,
3. Price for Business Plan - $180 annually/ $15 per month.
Detailed terms of service for each Plan are defined in the WebWave Builder Regulations available at https://webwave.me/terms-of-use and in the guidelines provided on the WebWave website. As part of a Plan, the Organizer may also provide a Domain registration service for the Participant.
II. DEFINITIONS
1. Price – means the total amount due from the Participant to the Organizer for the selected Plan on an annual basis.
2. Privacy Policy – WebWave’s privacy policy available at: https://webwave.me/privacy-policy
3. Discount – A reduction of the Price granted to each Participant who meets the conditions of the Promotion. The discount amount is 50% of the Price for the renewal of the Plan, along with an offer of a website audit and the option to complete the construction of their website as part of our DIFM (Do It For Me) program, provided that the Plan's price as of the Promotion commencement date is:
1. One Pager Plan - $84 annually/ $7 per month,
2. Pro Plan - $120 annually/ $10 per month,
3. Business Plan - $180 annually/ $15 per month.

5. Participant – a natural person, legal person, or organizational unit without legal personality that meets the conditions specified in sec. IV.3 and takes part in the Promotion..
6. Agreement – an agreement concluded between the Organizer and the Participant regarding the use of the Builder, under the conditions specified in these Regulations and in the WebWave Builder Regulations.
III. GENERAL PROVISIONS
1. These Regulations set out the rules and conditions for participation in the Black Month 2025 Promotion for customers whose Premium Plan expired at least 14 days before the start of the Promotion..
2. The Promotion is valid from 6 November 2025 to 30 November 2025.
3. Participation in the Promotion constitutes acceptance of the rules described in these Regulations and in the WebWave Builder Regulations.
4. The provisions of these Regulations are special provisions in relation to the provisions of the WebWave Builder Regulations. This means that to the extent not covered by these Regulations, the relevant provisions of the WebWave Builder Regulations apply, and in the event of any inconsistency between these Regulations and the WebWave Builder Regulations, the provisions of these Regulations shall apply.
IV. SUBJECT AND CONDITIONS OF THE PROMOTION
1. The subject of the Promotion is the possibility for the Participant to use the Discount and a website audit under the rules set out in these Regulations. The Discount may be used when selecting the specific Plan in the Webmaster Panel and making an annual payment for the Plan during the Promotion period.
2. By using the Promotion, an Agreement is concluded between the Participant and the Organizer for the use of the functions provided by the Plan, the registration of a domain, and the publication of a website under the domain selected by the Participant for the period for which the Participant has purchased access to the Plan.
3. The Promotion is available to a Participant who had a paid Plan and whose Plan expired at least 14 days before the start of the Promotion.
4. The Black Month 2025 Promotion cannot be combined with other actions/promotions currently conducted by the Organizer. The Participant may choose which action/promotion/discount to use, if such have been directed to them.
5. A Discount granted to the Participant under the Promotion is not exchangeable for cash.
V. COMPLAINTS
1. Each Participant of the Promotion has the right to submit a complaint regarding non-compliance of the Promotion with these Regulations during its term or no later than within 30 days from the date of purchase. Complaints submitted after this deadline will not be considered.
2. Complaints must be submitted via e-mail to the Organizer at: contact@webwavecms.com
3. A complaint should include: the Participant’s first name, last name, and e-mail address provided in WebWave, the reason for the complaint, the Participant’s demand, and a description of the circumstances justifying the complaint. If the Participant does not provide complete data, the Organizer will, where possible, request the Participant to complete the required data within one week, under pain of leaving the complaint unprocessed.
4. The complaint will be considered within 21 days from the date of its correct submission to the Organizer. The Organizer reserves the right to extend the time for handling the complaint if it is necessary to conduct explanatory proceedings or undertake other additional actions by WebWave. In such a case, the Organizer will inform the Participant who submitted the complaint about the extension and will set a new deadline for handling the complaint, not longer than 30 days.
5. The Organizer will inform the Participant who submitted the complaint about the outcome of the complaint review to the e-mail address from which the complaint was submitted by the Participant.
6. Complaints sent to an incorrect e-mail address, submitted after the deadline specified in item 1 above, or not containing the data referred to in item 3 above, despite an additional deadline being set for supplementing them, will not be considered.
VI. PERSONAL DATA, PRIVACY
The Organizer’s privacy policy, including the cookie policy and the rules under which the Organizer processes Participants’ personal data, are set out in the Privacy Policy.
VII. FINAL PROVISIONS
1. The Organizer reserves the right to amend these Regulations. The Participant will be informed about the content of amendments to the Regulations by electronic correspondence and by posting the current Regulations on the website at: https://webwave.me/terms-and-conditions-black-month-expired-plans
2. The Organizer reserves the right to cancel the Promotion before the end of the period for which it was designated. Cancellation of the Promotion will not affect Agreements concluded under the terms of the Promotion.
3. Any disputes that may arise in connection with these Regulations shall be resolved by the court of general jurisdiction competent for the Organizer’s registered office.
