Rules of the “Startup Promotion” 

(hereinafter the “Rules”) 

§ 1. Organizer 

The organizer of the “Startup Promotion” is WebWave sp. z o.o., [LLC] with its registered office in Warsaw (02-676) at ul. Postępu 14, entered into the register of entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number: 0000851194 [KRS: National Court Register number], holding NIP: 5272931749 [Polish Tax Identification Number] and REGON: 386580113 [Polish National Business Registry Number], with share capital of PLN 5,000 (hereinafter the “Organizer”). 

§ 2. Duration of the Promotion 

1. The Promotion shall be valid from 1.06.2026 to 31.12.2026 (hereinafter the “Duration of the Promotion”). 

§ 3. Participants of the Promotion 

1. The Promotion may be used by adult natural persons with full legal capacity, business entities, i.e. natural persons conducting sole proprietorships, legal persons, as well as organizational units without legal personality but possessing legal capacity (hereinafter the “Participant”), who during the Duration of the Promotion meet the conditions specified in these Rules.  

2. Participation in the Promotion is voluntary and requires the Participant’s consent to receive from the Organizer and companies of the WeNet capital group (i.e. WeNet Group S.A., WeNet sp. z o.o., Firmao Polska sp. z o.o.) unsolicited commercial information via all indicated electronic communication channels (i.e. email, SMS, and telephone) as well as consent to the processing of personal data for marketing purposes.  

3. The Participant may use the Promotion only once, using a single email address. One email address entitles the Participant to receive one discount. A Participant who has used the Promotion with a given email address may not use the Promotion again using a different email address.  

4. The Promotion applies to the Participant upon the first subscription to the Premium Plan, and the Participant may use it only within 7 days from the date of registration of the account in the Service. In order to use the Promotion, the Participant must switch from the trial period to the Premium Plan before the expiry of the period referred to in the preceding sentence.  

5. After the expiry of the period referred to in section 4, the Promotion becomes invalid, and the Participant may no longer use it, and it shall not be reactivated.  

6. After the end of the first annual subscription to the Premium Plan, the service shall be renewed according to the standard price list of the Organizer applicable on the date of renewal, unless the Participant cancels the renewal of the service in accordance with the rules specified in the Website Builder Regulations. The rules for providing the service and subscription renewal result from the Website Builder Regulations.  

7. A person acting on behalf of and for the benefit of the Participant, in particular a Participant that is a legal person or an organizational unit without legal personality but with legal capacity, registering in the Service and using the Promotion, declares that they are authorized to act on behalf of and for the benefit of the Participant, in particular that they are a person authorized to represent such entity or hold appropriate power of attorney.  

8. The Organizer is entitled to request additional documents confirming the authorization of the person referred to in section 7 to act on behalf of the Participant, and failure to provide such documents may result in refusal to participate in the Promotion or termination of the Participant’s participation in the Promotion. 
    

§ 4. Subject Matter and Conditions of Participation in the Promotion 

1. The Organizer is the owner of the website operating at: webwave.me (hereinafter the “Service”), on which it provides Users with a website builder enabling independent creation of websites, including online stores, under the name WebWave (hereinafter the “Builder”). Use of the Builder is possible after the User selects an appropriate paid plan: One pager, Pro, Business (hereinafter the “Premium Plan”), whereby the Premium Plans differ in terms of the technical conditions offered and their duration. Before selecting a Premium Plan, the User may use a free 14-day trial period. The rules of use of the Builder and the terms of service provision by the Company are set out in the WebWave website regulations available at: https://webwave.me/terms (hereinafter the “Builder Terms and Conditions”), in the wording applicable to the User.  

2. The Promotion covers a 10% discount (in words: ten percent) on the price of a selected annual Premium Plan used by the User (hereinafter the “Promotion”), under the terms specified in these Rules.  

3. The Promotion does not cover any fees other than the fee for the annual subscription for the use of the Premium Plan, i.e. it does not cover domain costs or additional services provided by the Organizer.  

4. In order to use the Promotion, the Participant must, no later than at the time of using the Promotion, switch from the free trial period to a paid Premium Plan.  

5. The Promotion may be used only by a new customer, i.e. an entity that, at the time of using the Promotion or prior to using the Promotion, has not been bound by any agreement with the Organizer and has not used the Organizer’s services under any other legal title – which means that the Promotion is available exclusively to entities registering an account in the Service for the first time.  

6. A condition for participation in the Promotion is also: 

   1. the Participant’s review and acceptance of the Rules and the Builder Terms and Conditions, 

   2. creation of an account in the Service by the Participant and providing, for this purpose: the User’s email address, password, and optionally the User’s telephone number. Account creation is available at: https://webwave.me/sign-up, 

   3. granting marketing consents referred to in §3 section 2. The Participant may withdraw such consents at any time (in the Builder Business Panel) or by submitting a request to contact@webwave.me. Withdrawal of marketing consents does not affect the right to use the Promotion, 

   4. switching to an annual Premium Plan within 7 days from the date of account creation in the Service and paying in advance the annual subscription fee for the Premium Plan.  

7. After the expiry of the period referred to in section 6 point d above, the Participant shall not be entitled to demand activation of the discount under the terms of these Rules.  

8. The Promotion may not be combined with other ongoing campaigns/promotions conducted by the Organizer. The Participant may choose which campaign/promotion/discount they wish to use, if such offers have been addressed to them.  

9. The discount granted to the Participant under the Promotion is not exchangeable for cash.  

10. All inquiries related to participation in the Promotion should be sent exclusively by email to: contact@webwave.me. 

§ 5. Personal Data and Privacy 

1. The provisions of this paragraph apply exclusively to a Participant who is a natural person.  
2. The personal data of a Participant who is a natural person or a natural person conducting business activity (“Participant Data”) include all information provided by the Participant to the Organizer in connection with participation in the Promotion, in particular identification data, contact data, information concerning conducted business activity, billing data, the content of correspondence and recorded telephone conversations, excluding data entrusted to the Organizer by the Participant for processing.  
3. The controller of Participant Data is WebWave sp. z o.o., with its registered office in Warsaw (02-676) at ul. Postępu 14, entered into the register of entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS No. 0000851194 [National Court Register number], holding NIP 5272931749 and REGON 386580113. 
4. The Organizer processes Participant Data: 
   1. for the purpose of implementing the Promotion and providing customer service – pursuant to Article 6(1)(b) of the GDPR; 
   2. for the purpose of fulfilling tax obligations related to the Participant’s participation in the Promotion – pursuant to Article 6(1)(c) of the GDPR; 
   3. for the purpose of marketing activities conducted by the Organizer within the scope of the controller’s legitimate interest – pursuant to Article 6(1)(f) of the GDPR, taking into account the Participant’s consents arising from the GDPR, the Act on the Provision of Electronic Services, and the Electronic Communications Law. Such consents may be withdrawn at any time without affecting the lawfulness of processing carried out prior to their withdrawal; 
   4. for the purpose of fulfilling legal obligations incumbent on the Organizer towards the Participant – pursuant to Article 6(1)(c) of the GDPR.  
5. Personal data of the Participant shall be processed: 
   1. for the duration of participation in the Promotion and use of WebWave services, 
   2. for the period required by tax and accounting regulations, 
   3. in the case of data processed on the basis of consent – until its withdrawal, 
   4. to the extent necessary to pursue or defend claims – until the expiry of the limitation period for claims.  
6. The Participant has the right to request access to their data, rectification, erasure, restriction of processing, data portability, and to object to processing.

8. The Participant has the right to lodge a complaint with the President of the Personal Data Protection Office.  
9. The Organizer’s privacy policy, including cookie policy and rules for personal data processing, is set out in the Privacy Policy available at: https://webwave.me/privacy-policy. 

§ 6. Complaints 

1. The Participant has the right to submit a complaint regarding non-compliance of the Promotion with these Rules during its duration or no later than within 30 days from the date of account creation in the Service referred to in §4 section 6 point b.  

2. Complaints shall be submitted via email to: contact@webwave.me.  

3. A complaint should include: the Participant’s first name, last name, email address used to create the account in the Service, the reason for the complaint, the content of the request, and justification of the complaint.  

4. The complaint shall be reviewed within 14 days from the date of its proper submission to the Organizer.  

5. The response to the complaint shall be delivered to the Participant via email to the address from which the complaint was submitted.  

6. Complaints sent to an incorrect email address, submitted after the deadline specified in section 1 above, or not containing the data referred to in section 3 above may be left unexamined.

§ 7. Final Provisions 

1. These Rules enter into force on 1.06.2026. The Organizer reserves the right to amend the Rules for important reasons, including: 

   1. changes in legal regulations governing distance selling; 

   2. organizational reasons affecting changes in: address data, name, or legal form of the Organizer; 

   3. technical or technological changes affecting the functionalities of the Builder, whereby such changes, in relation to a distance contract concluded with a consumer or a consumer-equivalent entity, may not be less favorable than the conditions applicable at the time of use of the Promotion; 

   4. actions beneficial to Participants, e.g. extending the duration of the Promotion.  

2. Participants using the Promotion shall be informed of any changes to the Rules 14 days in advance via email.  

3. The Promotion constitutes a temporary marketing campaign of the Organizer and does not constitute a public promise.  

4. The Organizer shall not be liable for difficulties in the implementation or inability to exercise rights arising from the Promotion by the Participant resulting from circumstances attributable to the Participant, including technical limitations of the Participant’s equipment or internet connection.  

5. In matters not regulated by these Rules, the provisions of the Builder Terms and Conditions (including provisions concerning the consumer’s right to withdraw from a distance contract) and Polish law shall apply, in particular the Civil Code Act of 23 April 1964 and the Consumer Rights Act of 30 May 2014. Capitalized terms used in these Rules shall have the meaning assigned to them herein or in the Builder Terms and Conditions.  

6. Any disputes and claims arising in connection with the use of the Promotion shall be subject to Polish jurisdiction.  

7. The governing law of these Rules shall be Polish law.
